Terms of Service

1. Who operates this service

Ben & Wicks is operated by Develofi, LLC, a Florida limited liability company, at 7901 4th St N, Ste 300, St. Petersburg, FL 33702. These terms form an agreement between you and Develofi, LLC. B3IP Holdings, Inc. owns the Ben & Wicks trademarks and underlying intellectual property and licenses them to Develofi, LLC. The service is available at cards.benwick.us, euchre.benwick.us, blackjack.benwick.us, and euchre-friends-designer.lovable.app.

2. Eligibility and accounts

You must be at least 18 years old to use the service. By using it, you agree to these terms. Guests may play without an account; optional accounts use an email sign-in code. Give accurate information, protect your codes, sessions and private invite links, and notify support@develofi.com of unauthorized use. You are responsible for activity you authorize through your account or seat.

3. Permission to play and prohibited uses

We grant you a limited, personal, non-exclusive, revocable, non-transferable license to use the service for lawful recreation. Do not cheat, exploit security weaknesses, access another player's private cards or account, scrape private information, distribute malware, harass others, upload unlawful or infringing content, impersonate anyone, or disrupt the service. Do not organize real-money wagering through the service. Gaming and gambling restrictions that apply where you are playing are covered in section 5.

4. Virtual chips and game disclaimer

Euchre and Blackjack are entertainment games. Chips, wallets, grades and scores are virtual game values only: they have no cash value, cannot be redeemed or withdrawn, and are not financial assets. The service currently offers no chip purchases, checkout or real-money payouts. Game results and practice do not predict results in real-money gambling. We may correct errors or reset virtual balances.

5. For fun only — no real-money gambling and local gaming restrictions

Ben & Wicks is strictly for fun. The service offers social card games played with virtual chips that have no cash value. We do not condone, support or facilitate real-money gambling in any form, and the service must not be used as a venue for wagering money or anything else of value. Chips cannot be purchased, sold, transferred, redeemed or exchanged for money, prizes or services, and any side agreement between players to pay for chips or results is between those players alone, violates these terms, and is not something we authorize.

Card games such as Euchre and Blackjack may be regulated as gaming or gambling in some places. Your use of the service is subject to the gaming, gambling and amusement restrictions of the locality where you are physically located when you play. You are solely responsible for knowing and following the laws, regulations and age requirements that apply to you in that locality. The service may be restricted or unavailable where use would be unlawful, and we may limit or block access by location to comply with applicable law.

You agree not to use the service to evade local gaming restrictions or to organize, promote or record wagers between players. Hosts are responsible for making sure play at their tables stays within the law where their players are located. If gambling has stopped being fun for you or someone you know, confidential help is available, for example the National Problem Gambling Helpline at 1-800-GAMBLER.

6. Your uploaded content

You retain ownership of artwork and other content you upload. You grant Develofi, LLC a worldwide, non-exclusive license to host, reproduce, display and distribute it within the service to operate your tables and saved designs. You are responsible for having the necessary rights and permissions, including for identifiable people in images. Do not upload confidential or sensitive information. We may remove content at our discretion, including for infringement, safety or operational reasons.

7. AI and automated features

Optional table talk may be generated by AI and may be inaccurate, incomplete or inappropriate. It is entertainment, not professional advice or a statement of fact about any player. Verify AI output before relying on it. Automated gameplay and grades may contain errors; you remain responsible for your decisions.

8. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, SECURE OR ERROR-FREE OPERATION OR ACCURATE RESULTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELOFI, LLC AND ITS LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE PREVIOUS 12 MONTHS OR $100. These limits do not restrict rights or liability that applicable law does not allow us to exclude.

10. Indemnification and termination

To the extent permitted by law, you agree to indemnify and hold harmless Develofi, LLC and its licensors from third-party claims, damages and reasonable expenses arising from your misuse, unlawful content or violation of these terms or others' rights. We may suspend or terminate access for violations, security concerns or discontinuation of the service. You may stop using the service at any time and request account deletion. Provisions intended to survive termination remain effective.

11. Florida law and disputes

Florida law governs these terms, without regard to conflict-of-laws rules. Subject to mandatory consumer protections, disputes shall be brought exclusively in the state and federal courts located in St. Johns County, Florida, and you consent to that jurisdiction and venue.

12. Changes and contact

We may update these terms by posting a revised version and date. We will provide additional notice of material changes where required by law. Continued use after changes take effect constitutes acceptance to the extent permitted by law. Questions: legal@develofi.com.
